FULL TERMS and CONDITIONS AGREEMENT
for Motorcoach Tours
with Diamond Tours, Inc (Tour Operator)
DEPOSIT and REGISTRATION
Non-Refundable Deposit:
Each of our tours require a $75.00 non-refundable deposit per person.
If you must cancel prior to final payment, you can choose to move your $75.00 per person to another motorcoach tour or apply it to a cruise or another trip.
Registration Creates Booking Reservation and Holds Seats for 10 days:
Completing a registration form for a tour officially creates your booking reservation and holds your seat(s) on the tour. Anderson Travel and Tours, LLC will hold your seat(s) on a tour for 10 days after receiving your registration form (prior to final payment).
Release of Seats on Reservation and Cancellation Fee:
After a tour booking is made, if we do not receive your $75.00 deposit per person within 10 days and we do not receive communication from you regarding any issues getting the deposit to us, your seats will be dropped and instead you will receive an invoice with a $75 per person cancellation fee due upon receipt and made payable to Anderson Travel and Tours, LLC only by check or cash.
FINAL PAYMENT
Invoice:
Once you have paid your $75 per person deposit, you will receive an invoice showing how much you owe for final payment. This invoice will also show the due date for when we must “receive” your final payment.
Booking a Tour after the Final Payment date:
If you book a tour after the final payment date, you must pay the full balance for the tour at once.
Non-Payment of Final Payment by the due date:
If you pay your deposit, but do not pay your final payment by the due date and do not contact us to make us aware of any issues and do not respond to communication from Anderson Travel and Tours, LLC regarding payment, your seat(s) will be dropped on the tour and you will forfeit your $75.00 deposit (you will not be able to use it toward another trip).
REFUNDS
- If the minimum number of people for a tour is not reached and Anderson Travel and Tours, LLC must cancel a tour, the full amount paid will be refunded to you. You can also choose to move your money to another trip.
- Cancellation Prior to Final Payment: you will receive a refund of any money paid minus the $75.00 per person non-refundable deposit.
- Cancellation After Final Payment: travel insurance must be filed in order to receive a refund. If you do not purchase travel insurance, you will not receive a refund if you must cancel after final payment.
ADA NOTICE:
The ability to walk unassisted for several blocks at a time is required for these tours. A guest must have the ability to walk on uneven sidewalks and natural terrain. Guests must be able to climb at least 7 stairs unassisted onto and off the motorcoach. Guests may not remain on the motorcoach at attractions, tour stops or during meals. There is no guarantee that attractions, buildings, hotels, restaurants, restrooms, etc. will be accessible/ADA compliant. Guests must be able to sit in a seat on the motorcoach next to another guest and must be able to keep their legs out of the aisle of the motorcoach for safety.
GUEST RESPONSIBILTY:
Guests will receive emails with invoices, updates and REQUIRED additional forms that must be completed prior to the tour such as a medical/emergency contact form, cell phone form, menu selection form, etc. Anderson Travel and Tours does NOT print/mail paper forms. A final itinerary that lists hotels, a packing list, parking instructions, tour information and rules, etc. will be emailed approximately 3 weeks prior to the tour. Guests must register to receive emails in order to receive these documents.
TRAVEL INSURANCE and MEDICAL RISK:
TRAVEL INSURANCE must be purchased at the time of booking to receive a refund after final payment.
PRE-EXISTING CONDITIONS: If you have pre-existing conditions or an injury, you must get written approval from your doctor stating that you are cleared to travel “prior” to booking and taking out travel insurance. Travel insurance must be purchased within 14 days of the date you write your deposit check for it to cover pre-existing conditions.
CLAIMS: All claims made by you through your travel insurance policy must be handled by you directly with the travel insurance company. Anderson Travel and Tours, LLC is not allowed to intervene in insurance claims or disputes.
RISK: Traveling may expose you to COVID-19, other viruses, allergens, contagions, bacteria, environmental hazards and the potential for injuries. By registering, you agree to travel at your own risk. Motion sickness is a possibility on tours. Guests must prepare ahead with medication, sick bags, etc.
RESPONSIBILITY: By registering for this tour, you understand and agree that Anderson Travel and Tours, LLC is not responsible for any sickness or injury you may acquire during the trip.

LIABILITIES, DAMAGES, DISPUTES

Travel Agency: Anderson Travel and Tours, LLC
Tour Operator: Diamond Tours Inc.
Tour Operator/Supplier:
I understand that Anderson Travel and Tours, LLC is not the source or supplier of the tours listed on this form and acts solely as an agent for the Supplier. The Supplier of these tours is a tour operator: Diamond Tours, Inc. (13100 Westlinks Terrace, Suite No. 1, Fort Myers, FL 33913). Diamond Tours, Inc. manages all 3rd parties related to this tour (examples: motorcoach companies, hotel chains, attractions, restaurants, travel insurance companies, etc.) I understand that the Supplier “Diamond Tours, Inc.” is the entity responsible for providing the travel services purchased.
Liability Tour Operator / 3rd Parties:
I understand that Anderson Travel and Tours, LLC assumes no responsibility for and shall not be liable for any refund, personal injury, property damage or other loss, accident, delay, inconvenience or irregularity which may be caused by: (1) any defaults, modifications to itineraries, timing or attractions, and/or wrongful or negligent acts, errors or omissions of the Supplier (Diamond Tours, Inc.); (2) any defect in or failure of any vehicle, craft, equipment or instrumentality owned, operated or otherwise used, provided or managed by the Supplier (Diamond Tours, Inc.); and any wrongful or negligent acts or omissions on the part of the Supplier (Diamond Tours, Inc.) or any 3rd party not under the control of Anderson Travel and Tours, LLC.
Liability / Disputes / Refunds / Penalties:
I understand that Anderson Travel and Tours, LLC is not responsible for, nor will I attempt to hold Anderson Travel and Tours liable for any inconvenience, injury, damage or loss I may suffer on the account of any conditions, changes, actions, negligence, errors or omissions by Supplier (Diamond Tours, Inc.). I understand that any monetary or other disputes must be handled directly with the travel Supplier (Diamond Tours, Inc.). In the event any refunds are issued by the Supplier (Diamond Tours, Inc.), I understand and agree the amount will exclude any agent commission earned by Anderson Travel and Tours, LLC. I agree that this disclaimer includes the entire traveling party and that in the event of any further disputes; they may only be litigated in the state of Alabama, with a maximum penalty not to exceed the total earned by Anderson Travel and Tours, LLC in the original transaction.
Photos-Videos:
I understand that photos and video will be taken during the tour by Anderson Travel and Tours, LLC as well as by other passengers and that I may appear incidentally in these images. I hereby consent to Anderson Travel and Tours, LLC the use of my image, voice or likeness which may appear incidentally in any video and/or photograph of the tour for any and all purposes without compensation.
Alcohol-Tobacco-Drugs:
I understand that the use or consumption of alcohol, tobacco products, and recreational drugs is strictly prohibited on the tour and that Federal and State laws prohibit smoking on a motorcoach/bus. (this includes vaping)
Personal Injury-Loss-Errors-Omissions of 3rd Parties:
I understand that the Supplier/tour operator (Diamond Tours, Inc.) assumes no responsibility for and shall not be liable for any refund, personal injury, property damage or other loss, accident, delay, inconvenience or irregularity which may be caused by: (1) any defaults, modifications to itineraries, timing or attractions, and/or wrongful or negligent acts, errors or omissions by any company or employee contracted by them to provide services/goods (transportation companies, hotels, restaurants, attractions, etc.) which is out of their control. (2) any defect in or failure of any vehicle, craft, equipment or instrumentality owned, operated or otherwise used, provided or managed by any company or employee contracted by the Supplier/tour operator (Diamond Tours, Inc.) and any wrongful or negligent acts or omissions on the part of any company or employee contracted by the supplier (Diamond Tours, Inc.) to provide services/goods.
Changes-Modifications-Delays-Complications-Rules:
Anderson Travel and Tours, LLC and/or their representatives and the Supplier (Diamond Tours, Inc.) and/or their representatives are not responsible for any consular, political, or military complications created voluntarily or involuntarily by the passengers or any other person. The Supplier (Diamond Tours, Inc.) does not guarantee departure and arrival times, which may be delayed by any number of factors, including weather, traffic or road conditions, mechanical problems or any other cause or condition beyond their control. The Supplier (Diamond Tours, Inc.) and travel agency (Anderson Travel and Tours) both reserve the right, without refund of any portion of purchase price, to refuse admission to or eject any person whose conduct is disorderly, who uses vulgar or abusive language or fails to comply with the rules, terms and conditions applicable to passengers on the tour.
Modifications-Changes-Substitutions-Cancellations by Tour Operator:
The Supplier/tour operator (Diamond Tours, Inc.) reserves the right to modify, change, substitute or cancel any part of a tour, advertised schedule, attraction and/or route for any reason and may do so without prior notice or compensation. The Supplier/tour operator (Diamond Tours, Inc.) reserves the right to cancel any tour in the event that, due to reasons beyond the control of Diamond Tours Inc., the trip cannot take place. In such an event, monies received by Diamond Tours Inc. would be returned in full.
Responsibilities of Anderson Travel and Tours, LLC:
According to United States law, notwithstanding anything in this Agreement to the contrary, Anderson Travel and Tours, LLC (travel agency) shall be responsible in the following circumstances: (a) if the travel agency negligently fails to warn of a known danger made aware to them and not disclosed to you (the client). (b) the travel agency breaches duty to pay the supplier, resulting in cancellation
