ANDERSON TRAVEL AND TOURS, LLC
CRUISE TERMS AND CONDITIONS
Anderson Travel and Tours, LLC is listed as โ€œAnderson Travel and Toursโ€ throughout this form.
CANCELLATION and FEE TERMS
โ€ข CANCELLATION FEE AFTER BOOKING IS COMPLETED (once a deposit is made and booking number created) there is a $75 per person Cancellation Fee. I understand that the $75 per person cancellation fee will be invoiced and payable directly to Anderson Travel and Tours and will not subtract from a deposit refund. I understand it is a separate fee paid directly to Anderson Travel and Tours for their time and resources spent on my booking.
โ€ข CRUISE CREDITS/CERTIFICATES/COUPONS (when applicable): I understand that if I make my deposit with a Certificate/Coupon from a cruise line, the amount paid will credit directly back to my certificate for use on a future cruise if I cancel my reservation. [Cruise line certificates/coupons are Non-Refundable for Cash. (refer to specific cruise line certificate/coupon terms and conditions.]
โ€ข CHANGE FEE: $50 per change. I understand that after a booking is created, major changes/corrections will incur this fee. (examples: name changes on a reservation after final payment, cabin changes, air changes, etc.) If airfare has already been ticketed when a change request is made, I understand that I may incur an additional fee from the cruise line or airline based on their fee schedules at the time of the change.
โ€ข ADDITIONAL RESEARCH / PLANNING / QUOTING FEE: $75.00 per request. You will incur this fee if you request new quotes for major modifications or additions to your trip requiring additional research, time and planning. (this is not for items like shore excursions or simple add-ons โ€ฆ this would be for major things that weren’t discussed during the initial planning phase like changing a full hotel-air-transfer package at a later date outside of the cruise package. (if we discuss it ahead of time and just add it later, this wouldn’t apply)
โ€ข CONCIERGE FEE: $75.00 per booking if you prefer for Anderson Travel and Tours to handle services for you that are beyond trip consultation, planning and booking. [I understand that: Anderson Travel and Tours is acting solely as an agent for the actual supplier of travel (cruise line) and that actions/services provided beyond trip consultation, planning and booking are considered concierge level travel services and are not requirements of the travel agency (Anderson Travel and Tours).] The supplier (cruise line) requires me (the client) to manage certain aspects of my trip such as, but not limited to: managing an online account on the supplierโ€™s website and downloading the supplierโ€™s app, receiving and reviewing emails from the supplier and agency, opening PDF documents, selecting/purchasing excursions and and/or additional services online, completing mandatory country-specific forms and/or other forms (such as accompanying minor forms, etc.) and/or any other required documents, completing online check-in (which may include uploading photos), printing e-docs and luggage tags, completing airline online check-in and downloading/saving or printing boarding passes, etc. (when air is part of a trip).
โ€ข PRINTING / MAILING FEES: I understand that if I require Anderson Travel and Tours to print and mail documents to me vs. downloading them from a file, I will be charged the additional cost of printing and postage.
IDENTIFICATION โ€“ PASSPORTS
โ€ข PROPER ID โ€“ NAME CHANGES: I understand that I (the client) am responsible for verifying that I have proper identification and that the names listed on my documents match my identification that will be used for the trip (Passport, Real ID driver’s license, TSA Pre-Check or Global Entry card, birth certificate, etc.) and on any other required documents or forms (vaccination cards, accompanying minor forms, country-specific forms, etc.). My first, middle and last name that is on my identification must exactly match the name on my cruise travel documents and my airline boarding pass or I could be denied boarding by the Suppliers (cruise line, airline). Anderson Travel and Tours nor the Suppliers (cruise line, airline) will be responsible if I am denied boarding due to my name not matching my travel documents. If any name change is required after final payment, there will be a $50 change fee due to Anderson Travel and Tours in addition to any fees incurred by the Supplier(s) (cruise line, airline).
โ€ข PASSPORT โ€“ WHEN MANDATORY: I understand that: if I am a U.S. citizen and my cruise embarks or disembarks in a foreign country, including Canada, a passport is mandatory. I understand a passport is also mandatory for a cruise that begins and ends in different U.S. ports.
โ€ข CLOSED-LOOP CRUISE โ€“ CRUISING WITHOUT PASSPORT: If I choose to travel without a passport on a closed-loop cruise (beginning and ending in the same U.S. port) and instead use a government issued REAL ID compliant Driverโ€™s License) and certified birth certificate, I understand that these documents WILL NOT be acceptable in an emergency and ONLY a valid U.S. Passport will be accepted to fly back into the United States from a foreign port. If I must stay in a foreign country due to an emergency situation (such as a medical evacuation, hospitalization, missing the ship in a port, ship mechanical issue requiring a flight home, etc.), I will need to consult the U.S. Embassy abroad to request an emergency passport and will be responsible for ALL FEES and EXPENSES for lodging, transportation, food, etc. that I may incur as a result. I understand that this applies to children as well as adults. I understand that travel insurance will not cover emergency expenses incurred from willingly traveling without proper identification to fly back into the United States. I will travel at my own risk without a valid U.S. passport.
โ€ข REAL ID: I understand that the U.S. Department of Homeland Security requires a driverโ€™s license to be a REAL ID (called STAR ID in Alabama) in order to fly domestically (inside the United States) and to enter federal building or visit military bases. I understand that international flights require a valid U.S. passport.
ADDITIONAL REQUIRED DOCUMENTATION โ€“ VACCINATIONS
โ€ข REQUIRED DOCUMENTATION AND VACCINATIONS: I understand that some countries require visas, additional entry forms, fees and requirements and it is my responsibility to ensure that I have completed all necessary items prior to travel. (examples: specific country visas, notarized consent for minors traveling without both parents, pre-travel authorizations like ETIAS for Europe) I also understand that certain VACCINATIONS may be required or suggested to visit certain countries and it is my responsibility to acquire the appropriate vaccinations prior to travel. I understand Anderson Travel and Tours is not responsible for helping me to acquire personal documentation and vaccinations prior to travel and is not responsible for any consequences I incur due to my failure to do so.
TRAVEL INSURANCE
โ€ข PRE-EXISTING CONDITIONS: I understand that travel insurance is available to purchase and that Anderson Travel and Tours can discuss travel insurance options with me. I understand that not all travel insurance covers pre-existing conditions โ€“ (please discuss options with Anderson Travel and Tours if you need a pre-existing medical condition covered). Pre-existing conditions and injuries require written approval from a doctor stating clearance to travel โ€œpriorโ€ to booking or buying travel insurance. Most travel insurance plans must be purchased within 14 days of the 1st deposit date for them to cover pre-existing conditions.
โ€ข REFUSAL TO PURCHASE TRAVEL INSURANCE: I understand that if I refuse to purchase travel insurance that I could lose the full cost of my trip or be responsible for the full cost of emergency situations due to (but not limited to) the following reasons: (*) if I or a travel companion must cancel after final payment due to an emergency or sickness (*) if my health insurance is not accepted or doesnโ€™t apply in certain U.S. states (domestic ports) or in a foreign country (note: many foreign medical facilities and providers require cash payment up front and do not accept U.S. insurance plans). (*) If I must be flown to a hospital or evacuated from a danger zone, (*) if a close relative passes away prior to departure (*) if an issue with weather or an airline causes me to miss the cruise departure (*) and/or other many other reasons. Without travel insurance, I will not be compensated for the cost of lost luggage, delays or trip interruptions. I understand that Anderson Travel and Tours nor the cruise line or any 3rd party will be responsible for losses or expenses incurred without travel insurance.
โ€ข TRAVEL INSURANCE POLICIES: Anderson Travel and Tours is licensed to sell travel insurance policies and can guide clients through the process of selecting a policy to meet certain needs. Anderson Travel and Tours can sell specialized policies with cruise lines and tour operators, policies through insurance aggregators and policies directly with travel insurance companies. (the same way they sell cruises, tours, etc.) However, Anderson Travel and Tours is not licensed to interpret specific insurance policy details and cannot be involved in insurance claims. I understand it is my responsibility to review a policy quote, research and ask questions prior to purchasing.
โ€ข TRAVEL INSURANCE CLAIMS: Once I purchase a travel insurance policy, I understand that I must read my policy documents thoroughly and know the process of how to file a claim if an emergency arises during my trip. I understand that detailed documentation, receipts, paperwork, etc. is routinely required by insurance companies for any event that causes a claim. I understand the claims process can be detailed and can sometimes take weeks to months to finalize. I understand that Anderson Travel and Tours is not responsible for and legally cannot settle claims between me and an insurance company and is not responsible for any errors or omissions made by an insurance company, cruise line, tour operator or other 3rd party offering travel insurance products.
HEALTH RELATED AND OTHER EXPOSURES
I understand that traveling may expose me to COVID-19, other viruses, allergens, contagions, bacteria, environmental hazards, natural disasters, and the potential for injuries. By booking, I agree to travel at my own risk and agree that Anderson Travel and Tours nor the Supplier (cruise line) nor any 3rd party is responsible for any sickness or injury I may acquire during travel or develop following travel. Anderson Travel and Tours must follow all updates, restrictions or mandates issued by the U.S. government and the Supplier (cruise line) at the time of travel and will not be able to make exceptions to any rules. Anderson Travel and Tours is not responsible for any inconvenience these rules may cause.
TRAVEL SUPPLIER TERMS
SUPPLIER and TRAVEL AGENCY: I understand that: Anderson Travel and Tours is not the source or supplier of travel and acts solely as an agent for the actual Supplier (cruise line). The Supplier (cruise line) is solely responsible for providing the travel services purchased. If airfare is offered as part of a cruise package and booked by the Supplier (cruise line) โ€“ all rules, changes, etc. are dictated by the Supplier (cruise line) and the air contract is with the 3rd party supplier (airline). Anderson Travel and Tours cannot choose or make changes to flights booked through a Supplier (cruise line) under certain airfare promotions.
NEGLIGENCE-DISPUTES: I understand that Anderson Travel and Tours assumes no responsibility for and shall not be liable for any refund, personal injury, property damage or other loss, accident, delay, inconvenience or irregularity which may be caused by: (1) any defaults, modifications to itineraries, timing or attractions, port changes, excursion changes, cancellations and/or wrongful or negligent acts, errors or omissions of the Supplier or any 3rd parties (cruise lines, airlines, ground transportation companies, tour operators, excursion guides, etc.) (2) any defect in or failure of any vehicle, craft, equipment or instrumentality owned, operated or otherwise used, provided or managed by the Supplier (cruise line) and/or by any 3rd party and any wrongful or negligent acts or omissions on the part of the Supplier (cruise line) or any 3rd party not under the control of Anderson Travel and Tours. Anderson Travel and Tours is not responsible for, nor will I attempt to hold Anderson Travel and Tours liable for any inconvenience, injury, damage or loss I may suffer on the account of any conditions, changes, actions, negligence, errors or omissions by Supplier (cruise line) or any 3rd party under the Supplierโ€™s control. I understand that any monetary or other disputes must be handled directly with the travel Supplier (cruise line). In the event any refunds are issued by the Supplier (cruise line), I understand and agree the amount will exclude any non-refundable fees already paid to Anderson Travel and Tours. I agree that this disclaimer includes the entire traveling party and that in the event of any further disputes; they may only be litigated in the state of Alabama, with a maximum penalty not to exceed the total amount earned in commission by Anderson Travel and Tours in the original transaction. *
CRUISE LINE CHANGES-SUBSTITUTIONS: I understand that: Anderson Travel and Tours and/or their representatives and the Supplier (cruise line) and/or their representatives are not responsible for any consular, political, or military complications created voluntarily or involuntarily by the passengers or any other person. The Supplier (cruise line) does not guarantee departure and arrival times, which may be delayed by any number of factors, including weather, mechanical problems or any other cause or condition beyond their control. The Supplier (cruise line) reserves the right to modify, change, substitute or cancel any part of a cruise and/or advertised itinerary for any reason and may do so without prior notice or compensation. The Supplier (cruise line) reserves the right to cancel any cruise in the event that the cruise cannot take place. Anderson Travel and Tours (travel agency) is not responsible for any changes or cancellations made by the Suppliers (cruise line, airline or other 3rd party supplier).
CRUISE LINE FUEL SUPPLEMENT: I understand that the Suppliers (cruise lines) reserve the right to charge a fuel supplement without prior notice should the closing price of West Texas Intermediate Fncrease above $65.00 USD per barrel on the NYMEX (New York Mercantile Exchange Index). In the event a fuel supplement is charged, the Supplier (cruise line) will have sole discretion to apply the supplementary charge to both existing and new bookings, regardless of whether such bookings have been paid in full. Such supplementary charges are not included in the cruise fare.
VAT TAXES DURING CRUISE: I understand that that I may incur extra tax on a cruise called a Value Added Tax (VAT) which is a consumption tax applied primarily to onboard goods and services while a ship is in specific territorial waters (not in the U.S.). Rates typically range from 8% to 22% and are added to purchases like alcoholic drinks, specialty dining, and retail. Typically, VAT is not applied once the ship is in international waters.
U.S. STATE-LOCAL TAXES DURING CRUISE: I understand that while a cruise ship is docked in a U.S. port or within state waters I may be charged a U.S. state/local sales tax on onboard purchases (drinks, dining, spa) and that these taxes typically stop once the ship enters international waters.
SPECIAL NEEDS
I understand that any disability requiring special attention and/or accommodations must be reported to Anderson Travel and Tours at the time of booking. Anderson Travel and Tours will make reasonable attempts to accommodate special needs with Suppliers, but is not responsible in the event it is unable to do so, nor responsible for any denial of services by Suppliers (cruise lines, airlines, ground transportation, hotels, restaurants or any other independent suppliers).
TRAVEL AGENCY RESPONSIBILITY:
According to United States law, notwithstanding anything in this Agreement to the contrary, Anderson Travel and Tours (travel agency) shall be responsible in the following circumstances: (a) if the travel agency negligently fails to warn of a known danger made aware to them and not disclosed to you (the client). (b) the travel agency breaches duty to pay the supplier, resulting in cancellation by the supplier.
