CANCELLATION TERMS

• Anderson Travel and Tours will charge a $25.00 cancellation fee per person if you cancel your booking after the 1st deposit is made. You will receive an invoice directly from Anderson Travel and Tours for this amount.

IF A CANCELLATION IS MADE BY GLOBUS

To the extent permitted by applicable law, Globus reserves the right to cancel or reschedule any trip departure for any reason, including insufficient demand, strikes, lockouts, riots, stoppage of labor or Force Majeure Event. In the event of a cancellation by Globus prior to departure for reasons excluding Force Majeure, Globus will try, at your discretion, to rebook the same trip with a different departure date, or a similar trip, but there is no guarantee of availability. Globus will refund the difference in price if the alternate is lower. You are responsible for additional costs if the alternate is higher. If this rebooking option is not acceptable to you, the only responsibility of Globus is refunding you the amounts paid by you for the reservation. In the event of a cancellation by Globus prior to departure or during your trip for conditions under Force Majeure, Globus will provide a future travel/booking credit for the portion of your trip impacted. Future travel/booking credit will be redeemable for travel with Globus for one year past your original trip start date. If a future travel/booking credit is not acceptable to you, in the majority of Force Majeure situations, you can notify the company within 21 days of advisement and you will be refunded the amounts paid by you for the portion of your trip impacted. If you do not notify Globus within 21 days of advisement, a refund is no longer available. Globus is not liable or responsible for any arrangements made independently. Globus assumes no responsibility for costs or fees you incur for independent arrangements not booked through Globus.

GLOBUS – ANY REASON CANCELLATION WAIVER Non-insurance feature provided by Globus family of brands

When you purchase the Globus family of brands Travel Protection, you will also receive the Globus family of brands “Any Reason” Cancellation Waiver that will provide you with 100% of the cancellation charges in the form of a future travel credit certificate, should you cancel your tour anytime prior to your scheduled departure for any reason that is not eligible for cash reimbursement under the Trip Cancellation Waiver. Cancellation charges are reimbursed in the form of Globus family of brands Travel Certificates allowing you a future travel certificate to travel with us at a later date! The travel certificate is valid for two years, is non-transferable, non-refundable and may not be redeemed for cash. Future travel certificates do not include airfare cancellation charges for air arrangements unless those arrangements were provided by Globus family of brands.

GLOBUS TRIP CANCELLATION WAIVER Non-insurance feature provided by Globus family of brands*

The Trip Cancellation Waiver offers guests the opportunity to receive a refund from Globus family of brands for the otherwise non-refundable trip costs prepaid to Globus family of brands if you need to cancel due to illness, injury, death, subpoena, jury duty, job transfer and more.

TRAVEL INSURANCE and COVID-19 TERMS:

• Traveling may expose you to COVID-19, other viruses, allergens, contagions, bacteria, environmental hazards and the potential for injuries. By registering, you agree to travel at your own risk. • By registering, you understand and agree that Anderson Travel and Tours and the travel Supplier (Globus) are not responsible for any sickness or injury you may acquire during the trip.

GLOBUS TRAVEL PROTECTION PLAN

The cost of the Globus Travel Protection Plan is included in your deposit amount and will be paid to Globus at the time of booking. The plan cost is nontransferable, nonrefundable and valid for each applicant only. • If you have serious pre-existing conditions, a recent injury, or have had recent surgery, you must get written approval from your doctor stating that you are cleared to travel “prior” to booking.

HEALTH AND SAFETY WAIVER

Signing of a Health & Safety Waiver is required for travel with Globus. You will not be allowed on trip without signing the waiver and you will be subject to the cancellation fees above. TRAVELERS NEEDING SPECIAL ASSISTANCE

You must report any disability requiring special attention at the time your reservation is made. Globus will make reasonable efforts to accommodate the special needs of tour participants. Such participants, however, should be aware that the Americans with Disabilities Act is inapplicable outside of the United States and facilities outside the United States for disabled individuals are limited.
For tours that include a cruise component: to request a wheelchair accessible room on a cruise, the traveler or person sharing the room must have a recognized disability that alters a major life function and requires the use of a mobility device and the use of the accessible features provided in the wheelchair accessible stateroom.
It is strongly recommended that persons requiring assistance be accompanied by a companion who is capable of and totally responsible for providing the assistance. Neither Globus nor its personnel, nor its suppliers, may physically lift or assist clients into transportation vehicles. Globus staff and the Service Providers are not required or trained to assist with personal tasks. This includes eating, dressing, toileting, lifting or pushing a wheelchair, walking, getting on or off transportation, or other personal needs.
Certain activities or venues may be limited or inaccessible to you if your mobility is limited in any manner. Many excursions and sightseeing involve extended periods of walking and standing often on uneven pavement or surfaces, and may include staircases, paths, walkways, or locations that are narrow or inaccessible or of limited accessibility by wheelchair. —No refunds are provided for missed services or activities due to your inability to fully participate with the group, including keeping pace with the group, if conditions requiring assistance are not known to Globus at the time of reservation or when reasonably known by the participant.

BAGGAGE DISCLAIMER

Although every effort is made to handle passengers’ luggage as carefully as possible, Globus is not responsible for and does not assume liability or accept claims for loss of or damage to luggage due to breakage, theft or wear and tear through hotel and group carrier handling.
Airline Checked Baggage Fees: checked baggage fees are not included in your trip cost. You will need to pay for your checked baggage during online check-in directly with the airline prior to your flights.

HOLIDAY AND MUSEUM CLOSURES

Museum visits and personal shopping time may be disrupted due to unforeseen circumstances or many religious, state and local holidays observed throughout the world.

MOTORCOACH SEAT ROTATION

Globus follows a mandatory, daily seat rotation on motorcoaches for all participants. However, seat rotation may not be available in all instances.

MOTORCOACH WASHROOMS

Most motorcoaches used on Globus tours are equipped with washrooms (except safari vehicles, exotic locations, and some Explorations tours). These motorcoach washrooms are typically for emergency use only. Globus will make plenty of comfort stops, allowing you the opportunity to use public restrooms and/or stretch your legs.

Maps shown on the Anderson Travel and Tours website or on the Globus website are current at the time of publication and may not reflect actual tour routing should the tour change. Photos shown are reflective of the area(s) visited, but may not be exactly what's included in the actual tour itinerary.

Explanation of Responsibilities and Tour Conditions for Globus Tours

Any person reserving or purchasing any Globus product accepts the condition that Globus reserves to itself the exclusive right to change or cancel itineraries, hotels, and other tour components whenever it is deemed necessary. If this occurs, every effort will be made to offer alternate dates and/or programs. Published times on itineraries are as accurate as possible but subject to change due to traffic, weather, mechanical and any other conditions beyond control that prevents Globus from operating as scheduled. Globus expressly disclaims any liability for any damages that may be incurred for any changes, cancellations or delays on any itinerary on any Globus tour.
Globus does not accept liability in the case of any passenger being denied boarding by any airline carrier due to the carrier’s over-booking of a flight. All cancellation charges, fees and refunds for any tour within this brochure are in effect as of the effective date as indicated below and supersede any other previously printed policies relating to these same charges.

GLOBUS GENERAL DISCLAIMER

Neither Group Voyagers Inc. (“The Company”) licensed to market and distribute travel products under the Globus, Cosmos, and Avalon Waterways brand names, its affiliated entities and its and their employees, shareholders, officers, directors, successors, agents, and assigns, own or operate any person or entity which is to or does provide goods or services for these trips. Group Voyagers Inc. (Globus) does not maintain control or operate the personnel, equipment, or operations of these suppliers it uses and as such assumes no responsibility for and cannot be held liable for any personal injury, death, property damage or other loss, accident, delay, inconvenience, or irregularity which may be occasioned by reason of (1) any wrongful, negligent, willful or unauthorized acts or omissions on the part of any of the suppliers or other employees or agents, (2) any defect in or failure of any vehicle, equipment, or instrument owned, operated or otherwise used by any of these suppliers, or (3) any wrongful, willful or negligent act or omission on the part of any other party not under the supervision and control of Group Voyagers Inc. (Globus).
Client shall indemnify and hold harmless Group Voyagers Inc. (Globus) its affiliated entities and its and their employees, agents, shareholders, officers, successors and assigns from all suits, actions, losses, damages, claims or liability for any personal injury, death, property damage or other loss, accident, delay, inconvenience or irregularity which is occasioned by any negligent acts or omissions of Globus arising out of any goods or services provided for this or these trips.
Additionally, responsibility is not accepted for losses or expenses due to sickness, lack of appropriate medical facilities or practitioners, weather, strikes, theft or other criminal acts, war, terrorism, computer problems, or other such causes. All services and accommodations are subject to the laws of the country in which they are provided. Globus reserves the right to make changes in the published itinerary whenever, in their sole judgment, conditions warrant, or if Globus deems it necessary for the comfort, convenience, or safety of the tour. Globus reserves the right to withdraw any tour announced. Globus reserves the right to decline to accept any person as a member of the tour, or to require any participant to withdraw from the tour at any time, when such action is determined by the tour manager to be in the best interests of the health, safety, and general welfare of the tour group or of the individual participant. Neither does Globus accept liability for any carrier’s cancellation penalty incurred by the purchase of a non-refundable airline or other ticket to the tour departure city and return or otherwise. Baggage and personal effects are the sole responsibility of the owner at all times.
Participants may be photographed for the promotional purposes of Globus. Payment of the deposit to Globus constitutes acceptance of these terms and conditions.

GLOBUS ARBITRATION

Group Voyagers Inc., at 5301 South Federal Circle, Littleton, CO is an independent company (“The Company”) licensed to market and distribute travel products under the Globus, Cosmos, and Avalon Waterways brand names, and arrange for the trip services, including transportation, sightseeing, and accommodations through independent contracts with third-party suppliers. GLOBUS and A WORLD BEYOND are trademarks and servicemarks owned and/or applied for and/or registered by Globus International Travel AG, Inc., in the U.S. Patent & Trademark Office and in other global jurisdictions. Group Voyagers, Inc., is an authorized user of the trademarks and service marks GLOBUS and A WORLD BEYOND owned by Globus International Travel AG.
Any dispute between the trip participant and The Company, directly or indirectly relating to the Terms and/or to the trip undertaken, shall be first submitted to mediation in Denver, Colorado, before a mediator mutually agreed to by the parties. Any action arising out of or related to these Terms and Conditions or the travel reserved or undertaken hereunder, shall be brought only in the courts of the State of Colorado. All trip participants agree that Colorado shall be the sole and exclusive venue for any such action and hereby consent to the jurisdiction of the Colorado courts for such action. Any claim against The Company must be brought within 12 months after the date of the completion of the trip and not later. The parties hereby agree and specify that claims may be brought only in the state or federal courts of Colorado, and the parties specifically consent to jurisdiction and venue in Colorado. Neither the parties nor any affiliate of the Company shall in any case be liable for damages other than compensatory damages, and the parties hereby waive any right to claim punitive or exemplary damages. The parties further agree that claims may be brought by parties only in their individual capacities and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. The parties expressly agree to waive and forego any and all rights to bring any such class actions, purported or proposed class actions, or representative actions. Colorado law governs this contract and all proceedings arising out of or related to this agreement.

STATED PRICES

Unless otherwise stated, all prices are per person, based on double occupancy, for specific room categories and subject to availability at time of booking on selected departure dates. Prices are valid at time of posting to the internet. Offers are capacity controlled and may be withdrawn at any time without notice. Some restrictions and blackout periods may apply. Globus is not responsible for errors of omission or information that may occur as a result of the transfer of information from selected third parties, technical or human error.

TRAVEL SUPPLIER TERMS

I understand that Anderson Travel and Tours is not the source or supplier of the tours listed on the webpage (https://www.andersontraveltours.com/2023-globus-tours) and acts solely as an agent for the actual Supplier. The Supplier of these tours is Group Voyagers Inc., at 5301 South Federal Circle, Littleton, CO – an independent company licensed to market and distribute travel products under the Globus, Cosmos, and Avalon Waterways brand names. Group Voyagers Inc. (Globus) manages all 3rd parties related to this tour (examples: motorcoach companies, hotel chains, attractions, restaurants, cruise lines, ferries, trains, other transportation companies, travel insurance companies, etc.) I understand that the Supplier “Globus” is solely responsible for providing the travel services purchased.
I understand that Anderson Travel and Tours assumes no responsibility for and shall not be liable for any refund, personal injury, property damage or other loss, accident, delay, inconvenience or irregularity which may be caused by: (1) any defaults, modifications to itineraries, timing or attractions, and/or wrongful or negligent acts, errors or omissions of the Supplier (Globus); (2) any defect in or failure of any vehicle, craft, equipment or instrumentality owned, operated or otherwise used, provided or managed by the Supplier (Globus); and any wrongful or negligent acts or omissions on the part of the Supplier (Globus) or any 3rd party not under the control of Anderson Travel and Tours.
I understand that Anderson Travel and Tours is not responsible for, nor will I attempt to hold Anderson Travel and Tours liable for any inconvenience, injury, damage or loss I may suffer on the account of any conditions, changes, actions, negligence, errors or omissions by Supplier (Globus). I understand that any monetary or other disputes must be handled directly with the travel Supplier (Globus). I agree that this disclaimer includes the entire traveling party and that in the event of any further disputes; they may only be litigated in the state of Alabama, with a maximum penalty not to exceed the total earned by Anderson Travel and Tours in the original transaction.
